2. Acceptance
By accessing or using BOMSync, you agree to these Terms and our Privacy Policy. If you are a business customer, processing of personal data on your behalf may also be governed by our Data Processing Addendum where applicable. If you do not agree, do not use the service.
3. Service
BOMSync is a software platform (including web apps, APIs, and add-ins). We may modify, suspend, or discontinue features with reasonable notice where practicable.
4. Accounts & access
- You are responsible for your credentials and for all activity under your account.
- You will provide accurate information and comply with applicable laws.
5. Customer data
You retain all rights to data you upload (“Customer Data”). You grant us a non-exclusive license to process Customer Data solely to provide and secure the service, as described in the Privacy Policy and, where you act as a controller and we act as a processor, the Data Processing Addendum.
6. Acceptable use
- No unlawful, infringing, or harmful content.
- No reverse engineering, scraping, or interfering with security or service stability except as permitted by applicable law.
7. Intellectual property
The BOMSync platform, documentation, and logos are owned by BIModular. “BOMSync” is a trademark of BIModular. You receive a limited, non-transferable license to use the service during a valid subscription.
8. Fees & taxes
Fees are per your order or subscription plan. Prices exclude applicable taxes unless stated. Unpaid amounts may lead to suspension after notice.
9. Confidentiality
Each party must protect the other’s confidential information with reasonable care and use it only for these Terms.
10. Warranties & disclaimers
The service is provided “as is” and “as available.” We disclaim all implied warranties to the maximum extent permitted by law.
11. Liability
To the extent permitted by law: (a) neither party is liable for indirect or consequential damages; (b) each party’s aggregate liability is limited to the amounts paid for the 12 months preceding the claim.
12. Term & termination
These Terms apply while you use the service. Either party may terminate for material breach not cured within 30 days’ notice. Upon termination, access ends; we will delete or return Customer Data per the Privacy Policy and retention rules.
13. Governing law & disputes
These Terms shall be governed by and construed in accordance with the laws of the French Republic. Venue for any disputes shall be the competent courts of Paris, France. Nothing in this section deprives consumers of mandatory rights under their local law, including data protection rights under the GDPR or UK GDPR where applicable.
14. Changes
We may update these Terms; material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.
